In the old days, Thailland was definitely an agricultural society. Trademark, as an important ingredient in manufacturing industy, did not play a signiticant role. The situation changed when Thailand (or Siam at that time) started to estadlish trade relation with western countries. The necessity of trademark system emerged together with the increase of foreign companies and businessmen accordingly.The Royal Thai Government established a Trademark registration office in the Ministry of Agriculyure and enacted a statute called the law about the registration of trademarks. Disputes concerning trademarks were very rare. The government of foreign countries, which wanted the Thai Government to pay attention to the use of foreign tradenmarks, usually called for the Thai Government to integrate the protection of among other matters into matters into the bilateral treaties with them.
When the time passed by, the mission concerning trademarks was increasingly important and accordingly needed more efficient administration. King Rama VI of the Chakri Dynasty, therefore, declared the establishment of the Deparment of Commercial Registration in B.E. 2466(1923) having the duties to announce and maintain the standard of measurements and to accept the registration of trademarks. The work with respect to the registration of trademarks was transferred from the Ministry of Agriculture to the Department of Commercial Registretion
The growth of domestic trade demanded the enactment of a new trademark law that could facilitate commerce better.In 1931 during the reign of King Rama VII, the Trademark Act B.E. 2474 was proclaimed.The British Trade Mark Act 1905 had much influence on the drafting of this Act. This new law then then abrogated the Law on Trade Marks and Trade Names of B.E.2457. The Trademark Act B.E.2474 had been in force for a long priod of time.During the period of its application,the Act was amended twice in B.E. 2476 (1933)and in B.E.2504(1961)
