The Obama administration is more prounion than business, and the Democratic majority on the NLRB is led by a former lawyer who represented unions. Even without the card-check law getting through Congress, the Obama NLRB has affected and is expected to continue to affect management-labor relations in favor of unions through making new regulations that don't need a law to be passed. For example, it already sided for labor and against business by upholding the rights of unions to set up protest banners outside compa-nies. The board could also rule on cases that would give unions greater access to company property for organizing drives, and it may push for a speedier election after workers peti-tion for a vote, limiting a company's ability to try to prevent unionization.
