Definitions: Words and expressions used in this Safety Manual shall have the meanings, as follows:
1) “Hazard Identification” means the process of searching for the imminent hazard and identifying characteristics of the hazard;
2) “Risk Assessment” means the process of estimating the risk levels and deciding whether such risks are at an acceptable level or not;
3) “Risk” means the possibility of occurrence and effect of the hazard;
4) “Work-related illness” means the illness resulting from working activities or working environment;
5) “Hazard” means the matters or situations which may cause work-related injuries or illnesses as defined in 4), damage to properties or damage to the working environment or all of these matters together;
6) “Near-miss Event” means an undesirable event that, when occurred, tends to cause accidents as defined in 7);
7) “Incident” means an undesirable event that, when occurred, could have resulted in accidents as defined in 8) or near-miss event as defined in 6);
8) “Accident” means an undesirable event that may not be expected, foreseen or controlled; but, when occurred, could have resulted in work-related injuries or illnesses or damage to properties or damage to the working environment or to the general public;
9) “Occupational Safety, Health and Environment Committee (OSHEC)” means the bilateral formation of a group of persons consisting of the Employer or the executive representative of employees as a chairperson; and elected representatives of employees in such workplace as members of the Committee or potentially including the highly technical safety officers or professional safety officers as members and the secretary of the Committee;
10) “Safety Section” means the occupational safety, health and environment unit assigned by the Employer to supervise and perform the operations relating to occupational safety, health and environment of the workplace;
11) “Occupational Safety” means the actions or working conditions which are free from the incidents that may cause hazard or work-related injuries to workers or may cause troubles or nuisance resulting from or in connection with the work;
12) “Occupational Safety Officer” means an employee who is appointed by the Employer to perform his/her duties as the occupational safety officer at a supervisory, managerial, technical, highly technical or professional level;
13) “Operational Employee” means an employee who is assigned by the Employer to perform his/her duties as the operational employee;
14) “Supervisory Employee” means an employee who is assigned by the Employer to supervise, to command and to order employees to perform their work according to the duties of such unit;
15) “Managerial Employee” means an employee at a managerial level or above;
16) “Occupational Safety Officer at a Supervisory Level” means an employee at a supervisory level who has received the training according to the criteria prescribed by the Director-General and has been appointed to perform his/her duties as the occupational safety officer at a supervisory level of the workplace; or who has ever been appointed as the occupational safety officer at a supervisory level according to the Announcement of the Ministry of Labour and Social Welfare on the Occupational Safety of Employees dated March 31st, 1997;
17) “Occupational Safety Officer at a Technical Level” means a person who has obtained at least a Bachelor’s Degree in Occupational Health or equivalent; or a safety officer at a supervisory level or an employee at a supervisory level and has received the training according to the criteria and methods prescribed by the Director-General; or a person who has ever been assigned as an occupational safety officer at a primary level according to the Announcement of the Ministry of Labour and Social Welfare on the Occupational Safety of Employees dated March 31st, 1997;
18) “Occupational Safety Officer at a Highly Technical Level” means a person who has obtained at least a Bachelor’s degree in Occupational Health or equivalent; or has obtained at least a Certificate of Technical Vocation, High Vocational Certificate, Certificate of Higher Education, diploma or equivalent; and has passed the training and test according to the criteria and methods prescribed by the Director-General; or has finished at least high school or has obtained the Vocational Certificate or equivalent; and has been working as an occupational safety officer at a primary or technical level for at least 5 years; and has passed the training and test according to the criteria and methods prescribed by the Director-General;
19) “Occupational Safety Officer at a Professional Level” means a person who has obtained a Bachelor’s Degree in Occupational Health or equivalent; or has obtained at least a Bachelor’s degree and has been working as an occupational safety officer at a highly technical level for at least 5 years; and has passed the training and test according to the criteria and methods prescribed by the Director-General as organized by an organization approved by the Department of Labour Protection and Welfare; and has been or used to be an occupational safety officer at a professional level according to the previous law; and has passed the additional training and tests according to the criteria and methods prescribed by the Director-General as organized by an organization approved by the Department of Labour Protection and Welfare, in the work-related programs within 5 years;
20) “Occupational Safety Officer at a Managerial Level” means an employee at a managerial level who has passed the training according to the criteria and methods prescribed by the Director-General; or an employee who used to be an occupational safety officer at a managerial level according to the Announcement of the Ministry of Labour and Social Welfare on the Occupational Safety of Employees dated March 31st, 1997;
21) “Personal protective equipment” means equipment and materials worn on any or several parts of the body to protect such parts of the body from injuries;
22) “Workplace” means the Employer’s workplace divided into units in which employees are working.
