(3) Except as otherwise provided in the applicable SLA set out in an Appendix (e.g., for Local Access service), Microsoft will be liable for repair and restoration of a Service if the Fault is a direct and sole consequence of Microsoft’s act or omission, subject to Section 12 (Limitation of Liability). Carrier will promptly provide notice to Microsoft if it is unable to correct any Fault in the Service that it believes is due to an act or omission of Microsoft.
