It is fairly clear that if the maritime boundary between East Timor and Australia were to be
delimited by a decision of the ICJ, it would not be a line drawn to join the Timor Gap or close
the gap through the middle of the JPDA. It is almost certainly the case that on the basis of
equitable principles the north-south boundary would be close to the line of equidist ance
between the two countries. However as has been pointed out this would only give East Timor
access to an additional 10% of revenue (i.e. the 10% that is paid to Australia under the terms
of CMTAS).
