This Agreement is done at 40 Krabi-Khoathong Road on this 5th day of June 2013 by and between Miss. Somsri Sae-jung hereinafter called “Lessor” of the one part and Mr. Tanyapat Jaroenchaleamsak hereinafter called “Lessee” of the other part. The parties hereto agree as follows:
(1) Lessor agrees to let and Lessee agrees to take the lease for commercial purpose of Commercial buildings located at 40 Krabi-Khoathong Road ,Paknam Sub-district Krabi Province for the term of 5 years commencing from 5 June 2013 henceforth. Lessee agrees to pay Lessor the rent at the rate of 8,500 baht - satang (eight thousand five hundred baht only) per month.
(2) Lessor has already received deposit money from Lessee for the amount of 25,500 baht - satang.
(3) Lessee agrees to pay Lessor the rent within the 5th date of every month failure to do so shall entitle Lessor to withhold Lessee’s personal properties and to lock the leased property.
(4) Lessee shall be responsible for property taxes.
(5) Lessee undertakes to maintain the leased property in good condition similar to its original condition. If Lessee wishes to make any alteration shall be solely responsible by Lessee. And any damage arisen out of such alteration shall be solely responsible by Lessee.
(6) All constructions or repairs done in the leased property may not be removed or destroyed in any circumstances when Lessee moves out from the leased property and all those constructions or repairs shall become entitled to Lessee where Lessee may not claim for damage. This Lease Agreement shall terminate if the leased property has suffered fire.
(7) Lessee shall allow Lessor or Lessor’s agent to examine the leased property at any reasonable time.
(8) Lessee undertakes not to sublet the leased property without prior written consent from Lessee and shall not allow any other person to conduct any trading or service business in the leased property without prior written consent from Lessor.
(9) Lessee shall always maintain the leased property to be free from filth and bad smell and shall not cause any annoyance or disturbance to neighbors. Lessee shall not keep fuel or do any act which may harm surrounding occupants. Lessee is not entitled to claim for moving cost or expense against Lessor.
(10) Lessee may not take up any fire insurance against Lessee’s properties or merchandise kept in the leased property without prior written consent from Lessor.
(11) If Lessee has agreed to sell the leased property to any person before the end of the term of this agreement, Lessor shall give notice to Lessee in advance to allow Lessee to have at least two month to prepare moving out. Lessor shall also notify Lessee in advance to whom and at what price Lessor shall sell the leased property to allow Lessee to have opportunity to offer reasonable purchasing price first.
(12) If Lessee has been in breach of any provision hereof or fail to fulfill any obligation hereunder, Lessee agrees that Lessor has the right to resume possession over the leased property and terminate this Agreement immediately.
(13) Upon the expiry of the term of this Lease Agreement or Lessor has sold the leased property as mentioned in Clause 11 or Lessee default in clause above, Lessee agrees that it shall be deemed that Lessee agrees to move out of the leased property.
(14) Both parties have read and understood the entire content hereof and thereby affixed their respective signature.
