Notwithstanding the above restrictions, in situations involving imminent danger to life or exposure to substantial risk to personal safety or personal injury or substantial loss of Company property, customer property, or property under the care, custody, and control of the Company, an employee may use a cellular telephone or Mobile Electronic Device while operating a vehicle to communicate with (1) emergency personnel or (2) any person that has the ability to immediately report or mitigate the danger or risk.
Managers overseeing operations in high risk areas where lack of real-time communication has the potential to expose employees to danger may waive the terms of this policy if the manager(s) has received prior e-mail or written authorization from the Region Vice President. High risk areas are defined as (1) locations where conditions of war exist, or where employees may be targets of terrorism or kidnappings or exposed to substantial risk to their personal safety; and (2) locations that have been or are being affected by a natural disaster.
Limited use of non-handheld Mobile Electronic Devices such as company provided Citizen’s Band (CB) radios, two-way radios and In-Vehicle-Monitoring Systems (IVMS) is permitted. The use of these devices may distract the vehicle operator; therefore, use must be limited to business critical needs and emergency conditions only.
Violation of this policy may result in disciplinary action up to and including termination of employment
