Dear Khun Amporn
After my return from Chiang Mai I had first to calm down because I was so disappointed and it
took me the weekend to think off how to proceed in this unsatisfied situation.
With reference to your Email send on Monday, 15 July 2015 and my site visit (inspection) on
Friday, 17 July 2015, I would like to inform you as follows:
After your information that every single point out of the check list has been completed 100%, I
travelled once again (this was not the first time!) with great pleasure to Chiang Mai in order to
complete the handover of the house. Unfortunately, my pleasure faded away more and more the
longer the inspection took place. In addition to that, I was also very surprised that even non of
the responsible person’s of Jirung were present at the inspection. For a later dispute and a
proper documentation of evidence, I have made pictures from all the shortfalls I discovered.
Khun Yaya and Khun Mod tried to convince me to sign a document where I commit to pay for
the house next week and the shortfalls will be fixed later – just to let you know – I am refusing
to pay anything unless you have done your job and the house is in a condition for a hand over I
can expect and accept (according to the contract).
Friendly speaking Kuhn Amporn, you simply lied to me when you wrote in your email below that
every single point on the check list has been completed 100%. In addition to that check list, I
come across an unbelievable dirty house which has to be cleaned before I can think of moving in
(see contract point #6.2). The backyard including the wall is also in an unacceptable condition
for a handover (it looks like there has been done some paintings and patchwork just the last
couple of days – sadly in an improper way – e.g. the floor outside has blisters, color is flaking
etc.). I have heard you hired consultants to inspect the house for the handover – regrettable I
have to inform you that this didn’t happen – at least what I have discovered.
As it has been proven that we do not progress at all (handover in March 2015 failed, handover in
April 2015 failed and now the handover in July 2015 failed again) I will continue as follows:

1.) Additional respite until Thursday, 23rd July 2015
I will give you above mentioned extension of days (which already have been discussed within
your team) to prepare a new hand over appointment (as you know, I am not living permanently
in Thailand and I have only limited time for such appointments and therefore these
appointments have to be prepared properly from your side in order not to fail permantly).
2.) Recharging of costs to Jirung (trip to Chiang Mai July 17)
I am also a business professional with clients and commitments behind – I (and Mario) have
again wasted our time and money for a useless trip to Chiang Mai which we will charge to you as
follows:

a.) General Remark:
As already mentioned, I do not live permantly in Thailand, next visit in Thailand is scheduled in
Dec. 2015 or Jan. 2016.
b.) Alternative 1:
I schedule the handover for Dec. 2015 / Jan. 2016 – again, if the handover fails, I will charge
you the costs in connection with the handover
c.) Alternative 2:
If you want me to inspect the house for the handover before Dec. 2015 / Jan. 2016, you have to
take over my costs for the inspection (e.g. flight tickets, accommodation, taxi etc.)
d.) Alternative 3:
I contract local professionals to do the handover in my name (right of representation) – cost per
inspection of THB 30’000 will be charged to you
e.) Alternative 4:

4.) Penalty
For each failed handover appointment, starting from Thursday 23rd June 2015, I will charge you
a penalty fee of THB 50’000,-- and a daily penalty rate of THB 1’000 for the delay.

5.) Settlement of Accounts
Pls. see my remarks in the column comments – I look forward to receiving your reply and
explanations.
6.) Transfer of title
According to the contract #7, the final transfer of the title will take only place if the seller of the
land has no debt to the bank – how can I proof that? I discussed this point with friends which
also have a construction company in Thailand.

8.) Central Facilities and the fees connected
Pls. provide me in writing that the fees for the central facilities will only start when the central
facilities are build, running and finalized – before that I will not pay for services which are not
available (e.g. garden in the backyard etc.)
I have the impression that a lot of discussed things are not remembered any more or at least
Jirung hope that I do not remember (e.g. plants in the backyard, different quotes on the sala,
differences of standard materials vs. our own bought materials etc.). It’s also good that Khun
Shampoo is back so I can refer to the promises made from her to me in the name of Jirung
when I decided to buy the property (e.g. height of our house etc.).
Khun Amporn, I am not looking for a legal fight and I am still ready to buy the house by finding
a solution outside the court but I am not willing to spend more time and money on lies and
unprofessional work.
