Part 8 – Quality Assurance
A. The SELLER is responsible for maintaining effective control of the quality of material, services, and workmanship. The SELLER shall bear any and all costs of internal testing and certification procedures necessary to maintain this standard. The SELLER may provide results of these tests and/or certifications to the BUYER, however is not obligated to unless otherwise and specifically required in the Specifications and/or Statement of Work.
B. The BUYER is authorized to conduct appropriate third party tests and/or inspections of the supplied material as part of his acceptance process; however the cost of any of these tests is the sole responsibility of the BUYER. If conducted, these tests / inspections must be based on the appropriate level of quality / standards / tolerances as required and specified by the Order.
C. Differences or disagreements concerning quality issues shall first be resolved by discussions between the parties based on the terms and conditions contained herein, and the standards, quality control requirements, and specifications contained in the Statement of Work and/or Design Criteria. Unresolved differences will be handled in accordance with Part-16 “Disputes” clause of this contract.
