With regard to jurisdiction over the water column above the seabed, Article 8
of CMATS refers to a line which is defined by means of a list of coordinates
of latitude and longitude joined by geodesic lines contained in Annex II of the
Treaty.Article 8 provides that for the duration of the Treaty, Australia will
“continue to exercise jurisdiction in relation to the water column, and sovereign rights over the resources of the water column” to the south of the linedefined in Annex II, while East Timor will exercise equivalent jurisdiction and
sovereign rights to the north of that line. Additionally, East Timor is required
to exercise these rights “in a manner that does not unduly inhibit petroleum
activities within the JPDA.”
The line defined in Annex II of CMATS is coincident with the southern limit of the JPDA established through the Timor Sea Treaty
