SCHEDULE 4: THE SERVICE CHARGE Part I
1.
(a) The annual cost of service shall mean the total cost to the Landlord of the services and other matters set out in the Part II hereto.
(b) The due proportion shall mean 25% of the annual cost of service.
(c) The Landlords financial year shall mean the 30th day of March in each year or such other
annual period as the Landlord may in its absolute discretion from time to time determine.
(d) The “excess” and the “deficiency” shall mean respectively the amounts by which the due proportion exceeds or is less than (as the case may be) the Initial service charge (hereinafter defined) in each of the Landlord’s financial years
(e) The “Initial Service Charge” shall mean the yearly sum of £250.00.
2. The Tenant will pay the Initial Service Charge to the Landlord by equal payments in advance on the usual quarter day next following the end of each of the Landlords financial year or the issue of the Auditors Certificate hereinafter mentioned to the end of the year in question whichever shall be the later (the Tenant will pay the excess to the Landlord or the Landlord will allow the deficient difference from the payment due to the Tenant) as the case may be and in the event of the excess or deficiency being in respect of the last year of the Tenant’s occupation of the said Premises such payment by the Landlord or the Tenant (as the case may be) will be made within 28 days of the receiving of a demand in respect thereof and the Certificate of the Landlords Auditors as to the annual cost of services and the due proportion of the amount of the excess or deficiency shall be conclusive evidence of the facts therein stated except in the case of manifest error.
Part II
1. (a) Matters to be included in the service charge being the cost to the Landlord in respect of the services and obligations which shall in fact be divided for or obligated in respect of the said Premises and/or the said Buildings.
(b) The cost of repairing and maintaining the structure roof and all other exterior parts of the Building known as 1st Floor 1- 7 School Street Westhoughton Bolton Greater Manchester.
2. The fees costs and expenses (including Surveyors and other professional fees) of or arising out of the lighting re-building cleansing repairing and replacing renewing altering and maintaining of all party gutters sewers drains pipes and watercourses or other conveniences belonging to or used for or which may belong to or be used for 1st Floor 1-7 School Street Westhoughton Bolton aforesaid or any part thereof in common with the other premises near or joining thereto
