Neither Thai culture nor their Medical Council has ever condoned compensated surrogacy or the use of brokers/agents. The exposure of a large commercial surrogacy industry in their own backyard has been an embarrassment. The ruling junta does not want Thailand to be a surrogacy hub and is expected to move quickly to outlaw the practice. New laws may take effect in the next few months.
Foreign governments will continue to process citizenship and passport applications for IPs exiting Thailand with a child through surrogacy. Foreign Governments cannot override the Thai government on customs control and exit processes. They have no role to play in Thai requirements such as court orders to transfer parentage.
Surrogacy in Thailand has been front page news in Bangkok for weeks now. This has forced the government to take more radical action to enforce a previously ignored court order requirement for new parents.
