As the Condominium project and this Purchasing Contract (Unit)(“PCU”) are subject to the Condominium Act with its latest amendment No.4 in 2008 ("CA 2008"). The CA 2008 provides for the use of the standard form of the Agreement to Sell and Purchase of Condominium Unit (Or. Chor. 22 form). Putting different or additional terms to the Or. Chor. 22 form in the PCU is not prohibited but the general rule applies in that all clauses to be put in the PCU must be beneficial and not detrimental to the Purchaser.
According to Or.Chor. 22 Form, the facilities of the Condominium that the Seller has advertised in the condominium unit sale must be registered as the common property of the Condominium.
Therefore, the Purchaser proposes that all Clause 2.2.3 must be revised as marked up herein to follow the substance of the Or. Chor. 22 form.
