Sakda’s two claims are interrelated.
When the LRC decided in Sakda’s favor that he had been terminated without fault as alleged by Meyer, he is automatically entitled to receive his full PF (i.e. Myer’s contribution as well).
But as Sakda’s case is being contested at the Labor Court, the PF payment has to be on hold, i.e. pending the outcome of the case at the Labor Court (and probably Dika Court too).
That is how Tisco’s legal dept should present to the Court.
Meyer has to concentrate on its petition for the revocation of the LRC award – which is more worrisome.
