Benny after talking with Edwin I think we must not allow Kag to set the ground rules. She needs to know that Edwin is in no rush to sell the land and can wait 2 or 3 years to allow the value of his property to increase. Kag needs to be told that with the death of Edwin’s mother hiss finances have greatly improved and no need for a quick fix.
Kag however plans to go to Europe with her boyfriend in the near future.
This will not be possible if ….
A) Edwin files the criminal charges detailed below against her.
B) Kag should be made aware that his daughter Meisie can not travel unless Edwin agrees.
This should focus Kag. Plus the fact that she has no rights to the house in Patong.
Here are the facts as I see them; The following are criminal offenses I believe? ….
1) As a result of Kag’s physical and mental threats Edwin was forced to flee Thailand.
2) Kag entered the house in Patong without permission and removed property belonging to the company;
Thus guilty of breaking, entering and theft.
3) Kag without authority acted as an agent for the company. Misrepresentation.
4) Signed agreements without approval. Forgery.
5) Accepted money on behalf of the company. Theft
6) Refused to adhere to the Phuket juvenile court conditions by refusing Edwin access to his daughter.
7) Child abuse. Using her daughter to gain advantages over Edwin.
8) Has an unpaid debt of close to 18 million Baht with Edwin on the Krabi land.
9) Defamation.
10) Spreading false rumours thus damaging Edwin and the companies reputation.
Kag is in a very serious situation and Edwin could tie her up in Phuket court for the next 5 years and she will not be allowed to leave Thailand. And as a convicted criminal Kag will loose custody of her daughter
I believe Kag should be offered the following deal …. Take it or leave it ….
Edwin will pay Kag 20% from the net proceeds form the sale of the Krabi land.
But will cease paying 35,000 Baht per month to Kag
Allow his daughter to travel to Europe on the understanding that he has unrestricted access to her and that her education shall not interrupted.
Neither Edwin nor the company will file criminal charges against Kag.
Edwin will for the moment deposit all moneys due to Meisie from the sale of Krabi land in a Dutch government guaranteed savings fund for her benefit when she reaches 30 years of age.
Deposit 20,000 Baht every month to a joint account in his and Meisie’s name.
Kag must immediately return the money to the company she received from the rental of the house in Patong.
Drop all all court cases filed against Edwin and agree not to file any future cases.
Post Motor Bike with ownership transfer documents to Bangkok.
Relinquish all interest in the house and company by transferring her shares to Meisie.
Cease to use her daughter to gain advantages over Edwin.
Kag must stop renting the house if so just take agents fee 5%
