(d) The Contractor shall ensure that Facility requiring electricity consumption shall perform efficiently to maximize the utility of the Electricity Provided in accordance with Good Industry Practice. The Employer shall improve power factor of the Employer's Facility to be not less than eighty five percent (85%) lagging. The Employer shall be entitled to inspect the efficiency of the Contractor's Facility performance during the Contractor’s operation at the 22kV connection point. In the event that the results from such inspection shows that certain Contractor's Facility does not work efficiently resulting in lower power factor than required, the Contractor shall:
(i) pay the estimated power factor charge at the rate of twenty (20) Thai Baht per kVAR excluding VAT; or
(ii) within thirty (30) days after receiving a notice from the Employer referring to such inefficiency, improve the work efficiency of the identified Contractor's Facility to reach the qualifications specified in this clause (d); or
(jj) if unable to improve the work efficiency in (ii) above, the Employer shall be entitled to install the power factor improvement unit at the Contractor’s electricity system at the Contractor’s costs; provided that the Employer shall deduct the installation cost from the next monthly Service Fee.
