Refer to our conversation over the phone, I would ask your kind advice regarding the Trade Union Establishment for Labor Regulations Registration as required before August 2013.
Please see below email message that I received from Ms. Le Thi Tuyet Mai, CRC HR Mgr. for asking consulting with the company to find out solutions
and she explained that HR team has tried to talk with Trade Union Department Officers for getting a special approval for registration due to the company staffs do not want to join Trade Union (just as an excuse). She let us know that her team has tried to stop talking with them but they suggest that in this case HR should to call a meeting with company staff and then they will come and explain about the benefits of Trade Union organisation. She is worried about what happens if in the meeting any of our staffs said that they want to be the Trade Union Member.
I have tried to ask her to send the latest the latest updated version in 2014, but unfortunately she hasn't. I don't know why she didn't send us to review. So, we have tried to searching for some details that are involved with Trade Union Law and found this attachment. (Please noted that this law effects from Jan. 1, 2013).
I am wondering for some sentence that she mentioned " In reality, if we have no Trade Union team in the company, we cannot register the labor Regulations, and we get fine if we have no registered Labor Regulations, that's is a round." Can we trust on her information? So, we need to find out more information by consulting with the legal team that
Therefore, could you please give me some advice on this . Is it a must by law or just a choice (on Voluntary Basis) for the Trade Union Establishment to the company.
