Resuming the impact of the few examples chosen in this paper for the sake of illustration it turns out that there are undoubtedly many deficiencies in implementing effectively labour law in Germany. The biggest problem evidently are the SME where the actor for internal monitoring, the works council, unfortunately quite often does not exist. Since – as shown above – external monitoring only has a fair chance to become effective if there is a functioning interactionwith the internal monitoring system it may well be doubted whether in the future the situation in the SME will change significantly.
