CHAPTER 7
COUNTRY OF ORIGIN MARKING
POLICY
While there are no Thai regulations setting forth country of origin marking requirements, as a general best practice, F-M will take steps to ensure that the marking is conspicuous, large enough to be read easily with the naked eye, and sufficiently permanent so that it remains on the article (or its container) until it reaches the ultimate purchaser.
BEST PRACTICES FOR COUNTRY OF ORIGIN MARKING
Currently, Thailand does not enforce any specific country of origin marking requirements. However, it is appropriate to follow general F-M rules as best practice pending any local enactments.
Accordingly, every article of foreign manufacture or production (or its container) should be marked at the time of importation so that the ultimate purchaser is aware of the name of the country of origin. The marking should be in a conspicuous place, affixed so as to remain on the article (or its container) until it reaches the ultimate consumer and should be as legible, indelible, and permanent as the nature of the article permits. If an article is unable to be marked, its container should be marked with the name of the country of origin of the article.
The ultimate purchaser is generally the last person in Thailand who will receive the article in the form in which it was imported. A Thai manufacturer may be the ultimate purchaser if the manufacturer subjects the imported article to a process, which results in a substantial transformation of the article. If the manufacturing process is merely a minor one which leaves the identity of the imported article intact, the consumer or user of the article, who obtains the article after processing, will be regarded as the "ultimate purchaser."
