Mr.Luhan and Nanjing Luhan Film & Television Culture Studio (“We”) stated that: July 9, 2015 “关爱八卦成长协会” (Wechat ID: gossipmaker) released a public Wechat article with the headline “Little Fresh Meat ‘L’ Becomes A Father, A Male MC 'R’ Returns to CCAV”. The article contains false information, such as “A withdrawn member from a certain Korean idol group 'L’ has become a father”. Majority of the information in the article insinuates “Little fresh meat with last name L” as being Mr.Luhan. The article has been widely reposted and spread by news media, websites and we-media.
Mr.Luhan has entrusted us to post a statement on Weibo this morning regarding “关爱八卦成长协会”’s article on Wechat which is a completely fabricated and defamatory article, and requested “关爱八卦成长协会” to delete the article immediately and make a public apology. After we made the above statement, “关爱八卦成长协会” not only did not stop the infringement behavior but instead they continued to act provocatively through Weibo insinuating a celebrity has secretly gotten married with a child.
In consideration of the said infringement behaviors and methods are very malicious, Mr.Luhan and we have entrusted Beijing Haiwen Law Firm to jointly release this warning letter to stop the infringement.
We hereby warn and declare, “关爱八卦成长协会”’s behavior for publishing the fabricated and false article, also the behaviors of related news media, websites and we-media that have reposted and spread this false news, have negatively affected Mr. Luhan’s reputation and public image, it’s a serious violation to Mr. Luhan’s rights of reputation and name.
According to No.246 and No.1&2, the said infringement behaviors may have exceeded the scope of civil liability and allegedly violated the Criminal Law, committing a crime. The publishers and disseminator of the fabricated and defamatory information may be investigated for related criminal responsibilities regarding the scope of publication and dissemination, repost amount, click rate and other criteria.
We hereby solemnly request that “关爱八卦成长协会” and the accountable person to delete the false and defamatory information and to cease all the infringement behaviors. We also require them to apologize before 17:00 today through media platforms (including but not limited to the Wechat official account of “关爱八卦成长协会” and other public media platforms) and to eliminate all negative effects. Moreover, we request each news media, websites and we-media to delete and to stop publishing and spreading the fabricated and defamatory information to the public before 17:00 today. Otherwise, Mr.Luhan and we will start the legal proceedings, including but not limited to civil litigation and criminal procedures, to investigate the civil and criminal responsibilities of related personnel, in order to protect our own legal rights and interests.
