This letter is to reconfirm that to date Tri Property has neglected to fully pay the Z Cape co-owners’ common area fees, and even the sinking fund fees. Z Cape juristic person has never given you any special privileges as a co-owner to avoid these obligations, nor could we as it would be patently unfair to the other co-owners.
As a result, the Committee has voted to insist that you pay all outstanding fees, including all fines imposed by the Condominium Act, by the End of this August to avoid Z Cape taking you to court on all these well-past-due fees and fines. And if we go to court, we will also be including all the failures of Tri Property to repair all the defects to Z Cape as you either promised, or lied by blaming us for a defect that is patently your own fault.
The Committee’s history over the past more than two years with Tri Property has been nothing but frustrating. Through QPM, we repeatedly complained of numerous significant defects, yet Tri Property ignored all of them until shortly before the two-year warranty deadline was to expire, meaning that Z Cape owners had to live with all these defects for two years, and the Committee then had inadequate time to follow up on what defects Tri Properties failed to repair or properly repair as warrantied.
At the most recent Z Cape general meeting, when we didn’t have a quorum to increase our co-owner common area fees, Tri Property refused to support a special meeting to have a quorum to raise the fees that we so desperately need, even more so as we are short so much of Tri Property’s own co-owners’ fees and sinking fund fees. Also, Z Cape has had and will have to expend much of its own funds on repairing the warranted defects that you failed to deliver as promised.
Therefore, as defined by the Condominium Act, Tri Property must pay to Z Cape the balance of all the sinking fund fees you owe, the balance of the co-owners’ fees owed through the end of 2016, and the 20% penalty of the amounts of your total co-owners’ common area fees for 2014, 2015 and 2016.
