Warranty and After-Delivery Services
8.1 Unless specified otherwise in this Agreement, The Service Provider hereby warrants that it shall commence the provision of the Service within the date prescribed herein. Should the Service Provider fail to do so, the Customer shall have the right to terminate this Agreement, and the right to immediately claim from the Service Provider any refund for any advance of the Remuneration (if any), including any losses and/or damages incurred therefrom, plus interest at the rate of __1.25__% per month, until all the aforesaid payments are made to the Customer fully and entirely.
8.2 The Service Provider hereby warrants that the Service provided by it hereunder is complied with all requirements stated herein and of the Customer in all respects, and it shall be free from any defect or error within the period of 180 days, commencing from the acceptance date of the last portion of the Service delivered by the Service Provider in writing. Should any defect or error be found during the aforesaid warranty period, the Service Provider shall make good of such defect and error within the period prescribed by the Customer at no costs to the Customer whatsoever. Should the Service Provider fail to do so, the Customer shall be entitled to claim penalty against the Service Provider at a daily rate of _0.5__% of the total amount of Remuneration, until such error and/or defect be entirely made good by the Service Provider. In this respect, the warranty period shall also be extended for the time lost during the period of founding error/defect and making good of same.
In any case or whatsoever, the total amount of liabilities, penalties, indemnities covered by the Service Provider under this entire agreement will not exceed the total amount of Remuneration.
