One of the major differences between the Model Law and the FAA are the specific grounds for setting aside an award although there is some overlap. For example, both provide that an arbitration award may be set aside if the parties’ due process rights have been violated. The Model Law ground (Article 34) is that a party did not receive proper notice or an opportunity to present its case. The comparable FAA ground (Article 10) is that the arbitrators were guilty of misconduct in refusing to postpone the hearing, upon sufficient cause shown, or in refusing to hear evidence pertinent and material to the controversy; or of any other misbehavior by which the rights of any party have been prejudiced.
