a.) The trust shall provide regular living expenses up to $1000/ month to Anong, to be used for both living expenses and the educational needs of Napasson. Additional expenses may be advanced as necessary. The trustee may elect to make educational expenditures for napasson, offering a college education for her if possible.
b.) When Napasson reaches the age of 21, one-half of the estate shall be disbursed to Anong Ponok or to Napasson Yosrungsa if Anong should fail to survive. The remainder of the estate shall be disbursed the same way when Napasson reaches the age of 25.
i. The trustee shall hold the trust estate until Napasson reaches the age of twenty-five (25) years. The trustee shall begin distribution as followes: upon Napasson reaching age eighteen (18), Anong Ponok shall receive one-half of the turst, and the second one-half share of the trust at age twenty-five (25). In the event that Napasson dies before reaching age 18 age, the entire trust estate shall be disbursed to Anong Ponok.
ii. If Anong shold die before Napasson reaching the age of eighteen (18) years, the trustee may also make discretionary distributions for the benefit of the descendants of such deceased beneficiary, if any.
iii. The following administrative provisions shall apply to this trust:
1. Unequal Benefits. The trustee need not apportion discretionary distributions and benefits equally, but may consider all individual circumstances.
2. Beneficiaries statements. The trustee may request and rely upon written statements from the beneficiaries, their parents or guardians, as to income resources and the other considerations identified above, and suspend benefits during any period a requested statement is not furnished.
3. Tangible Personal Property. The trustee, in his or her discretion, may retain trust assets which are tangible personal property which he/she believes may have sentimental value to a certain child, in which case he/she shall distribute these assets equitably to him/her at such time or times as he/she thinks appropriate.
4. Retention of Assets. The trustee shall have full power and authority to retain any asset received from my estate in the same form in which it is received or to liquidate trade or otherwise alter the form of the asset.
5. Payment of Expenses. The trustee may, in his or her discretion, pay all or part of the expenses of last illness and funeral upon the death of a beneficiary, her spouse or issue.
6. Distributions to Another for a beneficiary. The trustee, in the exercise of his or her discretion, may apply benefits directly for the benefit of a beneficiary, pay the same to the custodian or guardian of the beneficiary or directly to the beneficiary. The --
