The confidentiality duties set out in this provision shall also extend to all employees, subcontractors, and
agents of the parties without any regard for the type and legal nature of the collaboration. The Contractor and
BMW undertake to subject this group of people to the appropriate confidentiality duties if this has not already
happened.
The confidentiality duties set out in this provision shall not exist if and in as far as the relevant information can
be proven to have been in the public domain or became part of the public domain at no fault of the party
obliged to treat it as confidential or was or is legally obtained by a third party, or was already held by the
receiving party, or must be disclosed as a result of binding regulations, in which case the receiving party must
inform the disclosing party in advance and in writing before any binding disclosure takes place unless it is
unreasonable to expect such prior information.
15.4
The Contractor may only publicise its business relationship with the BMW Group with the prior written consent
of BMW. The current version of the marketing guidelines "Points of reference for BMW Group partner/supplier
communication" shall be applicable and must be followed by the Contractor. This is published on the BMW
