The vast majority of Biocatalysts' products are outside the scope of the recent REACH legislation. Food grade enzymes are defined as food stuffs and are therefore exempt. Products used in pet food manufacture are also exempt.
REACH Article 2(5)(b) exempts substances used in food or feedingstuffs in accordance with Regulation (EC) 178/2002 including use in animal nutrition within the scope of Directive 82/471/EEC from Registration under REACH (Title II), as well as from the titles on downstream users, evaluation and restrictions (Titles V, VI and VII). Quantities of the same substance used for other purposes are not exempted.
Regulation (EC) 178/2002 covers food (or foodstuff), meaning any substance or product, whether processed, partially processed or unprocessed, intended to be, or reasonably expected to be ingested by humans. The Regulation applies to all stages of production, processing and distribution of food and feed.
Thus the definition of "food" under Regulation 178/2002 does not specifically require that the substance is in its final form for consumption and substances in unprocessed food, as well as substances in processed (including cooked) food are exempted from REACH in accordance with Article 2(5)(b) of REACH.
Food enzymes used as food additives or in animal nutrition (i.e. that are intentionally incorporated into food during its manufacture, preparation or treatment), should be considered as food or feeding stuff in accordance with Regulation (EC) 178/2002, provided that they are intended or can be reasonably expected to be ingested'
The technical and diagnostic enzymes are currently not covered by REACH because of the small volumes produced in this sector.
