19. Penalty for an offence under section 15, 16, 17 or 18
A person who contravenes the provisions of section 15, 16, 17 or 18 shall be guilty of an offence
and shall, on conviction, be liable to a fine not exceeding fifty thousand ringgit or to imprisonment
for a term not exceeding two years or to both.
• Under this section it is useful to understand the term ‘person’. In the Interpretation Acts
1948 and 1967, person is defined as “person” includes a body of persons, corporate or
unincorporate. Therefore ‘a person’ includes:
• natural person
• body corporate e.g company
• unincorporate e.g sole proprietor or partnership
• Hence the natural person, body corporate and unincorporated can be found guilty and liable
to fined.
