Another important legislation in each state is the Workers Compensation Act. The Workers Compensation Act establishes a framework for the compensation of employees injured in the workplace and the funding payments made to or for the benefit of injured employees.
Importantly, the Workers Compensation Act imposes a general liability on an Employer for injury to or death of an employee which arises out of or in the course of employment. In some instances and Employer can show that he was not responsible for the injury or death to an Employee.
Under the Workers Compensation Act, compensation is payable to an injured employee whether the injury was received by the worker at or away from the worker’s place of employment which, for example, allows employees to make a claim for worker’s compensation received on the way to or from work, also known as “Journey claims”.
