7.1.2 If Lessee fails_Lessor may terminate this agreement and Lessee may not make any further claims – this cannot be correct as I the Lessee would have paid the full lease amount (3 600 000 THB) and the Lessor could cancel this agreement for a small debt i.e. 1 year maintenance fee not being paid 30 days in advance and the Lessee would loose his full investment without being able to claim the big amount he had invested less the debt.
This section is totally unfair and should read in a totally different manner. The Lessor must claim his debt through the courts after trying all other dispute resolution mechanisms. If the court then orders the lease to be sold, the Lessor can get his money with expenses incurred whilst the Lessee can receive the remainder of the money as is normal.
