necessary for the proper completion and maintenance of the WORK, and for complying with any instructions which OWNER may issue to CONTRACTOR in connection therewith.
0.0.5 CONTRACTOR shall give or provide all necessary superintendence during the execution of the WORK and as long thereafter as OWNER may consider necessary for the proper fulfilling of CONTRACTOR’s obligations under this CONTRACT.
0.0.6 CONTRACTOR shall submit monthly progress reports of various aspects of the WORK to OWNER. The report period and a sample format of such progress reports are to be submitted to OWNER for APPROVAL and may be changed at OWNER’s option. CONTRACTOR shall give a written notice to OWNER whenever planning or progress of the WORK is likely to be delayed or disrupted. If for any reason, which does not entitle CONTRACTOR to an extension of time, the rate of progress of the WORK or any part thereof is at any time, in the opinion of OWNER, too slow to ensure completion of the WORK by the prescribed time or extended time for completion, OWNER shall so notify CONTRACTOR in writing and CONTRACTOR shall thereupon take such steps as OWNER deems necessary to expedite progress so as to complete the WORK or such part thereof by the prescribed time or extended time. CONTRACTOR shall be responsible for any expenses which may incur from taking such steps and shall not be entitled to any additional payments unless otherwise agreed in writing by OWNER. If CONTRACTOR fails to commence and diligently continue to take action to expedite progress of the WORK within 10 (ten) DAYs after receipt of written notice from OWNER or CONSULTANT to expedite progress of the WORK, OWNER shall have the right to hire other contractor to carry out work, and CONTRACTOR shall promptly reimburse OWNER for such costs for expediting the progress WORK.
Such action by OWNER shall not release CONTRACTOR from any of his responsibilities and liabilities under the CONTRACT.
0.0.7 CONTRACTOR shall, in accordance with the requirements of OWNER, afford all reasonable opportunities to any other contractors employed by OWNER, OTHER PACKAGES, and their workmen and to the workmen of OWNER and of any other duly constituted authorities who may be employed by OWNER in the execution on or near the SITE of any work not included in this CONTRACT or of any contract which OWNER may enter into in connection with or ancillary to the WORK, for carrying out their works.
0.0.8 CONTRACTOR shall indemnify and hold harmless OWNER from and against all losses, costs, expenses, damages and claims in respect of deaths, injuries or damage to any person or material or physical damage to any property whatsoever which may arise out of or in consequence of the execution and maintenance of the WORK prior to OWNER’s issuance of the CERTIFICATE OF FINAL ACCEPTANCE, except any compensation or damages for or with respect to:
(i) The permanent use or occupation of land by the WORK or any part thereof, which is not caused by the fault of CONTRACTOR, its agents or its employee.
