11 suspension of rent
if the leased space or any part thereof are rendered unfit for use or inaccessible by fire, water, storm, wind, acts of god, force majeure or other causes beyond the control of the lessor or lessee and not attributable to any failure of the lessee to observe and perform its obligations, the rent or a part thereof in proportion to the extent that the leased premises has been rendered unfit for use or inaccessible shall cease to be payable from the date of occurrence of such damage until the leased premises has been rendered fit for use or accessible. notwithstanding the above, the lessor and lessee shall have the right at its option to terminate this agreement forthith and the lessor shall refund any unused portion of the rentals calculated on a prorate basis over the full term of this agreement without interest or penalty to the lessee.
