In addition to this seemingly all-encompassing statement, the parties also
agreed in explicit terms that neither side would “commence or pursue any pro-ceedings against the other Party before any court, tribunal or other dispute set-tlement mechanism that would raise or result in, either directly or indirectly,
issues or findings of relevance to maritime boundaries or delimitation in the
Timor Sea.”
Moreover, it was agreed that any such court or tribunal hearing
proceedings involving the parties “shall not consider, make comment on, nor
make findings that would raise or result in, either directly or indirectly, issues
or findings of relevance to maritime boundaries or delimitation in the Timor
Sea” and that even were such comments or findings made they shall have “no
effect, and shall not be relied upon, or cited, by the Parties at any time.”
The provisions concerning the inadmissibility of court findings are, therefore,
apparently permanent in nature
