7 Delivery
7.1 The delivery of Products hereunder shall comply with the purchase order and shall be Ex-works at Supplier’s factory (Incoterms 2010).
Note: Need to be finalized with the pricing agreement
7.2 The delivery date shall be in accordance with the purchase order unless otherwise agreed by both parties in writing.
7.3 Supplier shall not be deemed default of delivery date if the delay is caused by Pioneer’s failure to perform delivery under Clause 2 above.
7.4 If the root cause of the delay is attributable to the Supplier, then Supplier shall endeavor to make a recovery plan and provide the recovery plan to Pioneer within 48 (forty eight) hours from the date of delay.
7.5 In case the Supplier cannot make recovery in time for Pioneer delivery to customer and Pioneer has to use its own line to make recovery in time for the delivery to Pioneer’s customer, the Supplier will be charged for the Pioneer production cost for recovery which Pioneer will inform the Supplier prior to the charge. However the maximum charge will be limited to the Supplier’s assembly price as per Clause 6 of this Agreement, relative to the number of units that is affected by delivery problem.
7.6 If the delivered products have quality problem and need to be screened by Pioneer staffs the Supplier will pay for the cost of the recreen. However the maximum charge will be limited Supplier’s assembly price as per Clause 6 of this Agreement, relative to the number of units that is affected by quality problem.
