5. Hours of Work
(1) The working hour pattern is subject to project requirement and an adjustment by the RF Engineer
(2) The Engineer is to complete all assignments regardless of the time needed. There is no extra overtime pay.
6. Taxes
(1) The Engineer will be responsible for all income taxes to the Thailand Government for all payments received from the Company, and also to the country he/she is from.
(2) Withholding tax will be deducted by the company
7. Confidentiality
The Engineer must keep confidential all Company business and secrets such as company clients and matters made known to him during the course of the assignment and for a period of 2 years afterwards.
8. Safekeeping and Return of Documents and all Properties
The Engineer is responsible for the safekeeping of company documents and properties made available to him and must ensure that the contents thereof are not disclosed to any third party. During the contractual period & prior to the Engineer’s Departure, documents and properties made available to him must be returned to “the Company” in all cases. Any copying of such material is strictly prohibited. The safekeeping and return obligations apply to all written and electronically stored materials relating to the Company or Company’s clients (such as designs, drawings, software, tools, stored databases etc.) which are in the Engineer’s possession or otherwise stored.
9. Rights to the Finished Work and Intellectual Property Rights and Confidentiality
All items created by the Engineer such as specifications, computer programs, tools, procedures, sets of diskettes & their soft material, designs, drawing, tapes lists and other programs and documentationbelong to “the Company”. The Engineer acknowledges and accepts all Company information that is provided to him, and all patents, copyrights, design rights, trade secrets and other proprietary rights related to the Company’s information and or relating to items which are the result of the Engineer’s works shall remain the property of “the Company”
10. Termination and Penalty
(1) The Company has the right to terminate this Contract, should the Customer(s) is not satisfied with the performance of the Engineer. In this case, one week notice for terminating the Contract is required, and no penalty or layoff fee should incur.
(2) Either party has the right to terminate the Contract without any penalty; however one-month notice is required in this case. Should the termination is initiated by the Company, no extra layoff fee should incur, and it is already included in the hiring package.
11. Renewal
Negotiation will be made at least one month before the expiry of the Contract, should both parties agree to renew it.
12. Breach of Contract
The Company has the right to terminate this Contract without any penalty or layoff fee and to
withhold all financial remuneration should conditions and terms of this Contract not be strictly uphold by the Engineer.
13. Disclosure
Terms and conditions in this Contract should be treated as highly confidential and should not be disclosed to any third party.

10 การยกเลิกและการลงโทษ
