FORMER Gossip Girl star Kelly Rutherford has failed to gain custody of her kids and will only be able to visit them in Monaco and France, according to a report on Tuesday.
The 47-year-old actress went bankrupt blowing $1.95 million on her bitter divorce from Daniel Giersch.
She was also awarded a paltry $4,559 a month in maintenance from the German-born businessman, the Daily Mail reported.
The rulings by a judge in Monaco followed a legal brawl that erupted in August, when Rutherford was forced to surrender son Hermes, nine, and daughter Helena, six, to Giersch’s mother inside a closed New York City courtroom.
One of the kids was heard shouting “Mummy!” through the doors before Rutherford emerged, looking distraught.
Giersch — who won primary custody of the kids in 2013 — had accused Rutherford of breaking a promise to send them back to him in Monaco following a summer vacation in America.
The 46-year-old denounced Rutherford’s controversial decision as kidnapping.
Moving forward, the children — who have lived with their father in Monaco and France since 2012 — will remain with Giersch, while Rutherford is “only permitted to exercise her visiting and accommodation rights exclusively in France and Monaco.”
Rutherford’s lawyer has declined to comment but the actress told People magazine in August: “My children ask me all the time if I am still fighting for them ... I always tell them the day will never come when I say no.”
