SUBJECT: CLAIM FOR A REVISED DECISION
We kindly request you to revise your December 19th 2014 decision to disqualify DNA for the Thai Overseas
Stations Project. It is our sincere belief that your decision was based on incorrect information and that DNA
does qualify as a bidder as per your bid process terms. Our view on this issue is based on the following facts:
1. Your decision on Dec 19th was, according to you letter, based partly (first of two reasons given) on DNA not
submitting Bidder Qualification documents This is in fact not correct and DNA did submit said documents. albeit
partly not in the envelope requested, but in part in proposal (Section 2) envelope as grouping documents this
way is standard process in Europe. We ask that you overlook this minor delivery method error as all requested
documents have in fact been delivered to you and you are in possession of all pertinent information to evaluate
DNA as a bidder.
2. Your decision on Dec 19th was, according to you letter, based partly (second of two reasons given) on DNA
not submitting Bid Security. This is not in fact correct as DNA did submit Bid Security as requested. DNA did
also pose a question regarding Bid Security, but after receiving no answer on the matter, we did pay Bid
Security as requested, It is our belief that DNA posing a question regarding Bid Security was incorrectly taken
as non-conformance to bid terms without investigating the matter of DNA payment any further. We ask that you
look into this matter as that will cause you to discover DNA payment and conformance on this matter.
After considering the above, we are confident that you will find that there are no valid reasons for disqualifying
DNA from the bid process and allow us back in.
