21. Seller’s liability for damages resulting from any cause whatsoever (other than as provided in paragraph 17), whenever arising in contract (including fundamental breach), tort (including sole, contributory, concurrent or joint negligence), strict liability or other form or legal theory shall not exceed $10,000 or the price of the quantity of the product in respect of which damages are claimed, whichever is greater. In no event shall Seller be liable for any damages resulting from loss of profit or income, loss of use of property, any interruption of or to Buyer’s business, or other indirect or consequential damages however caused whether arising in contract (including fundamental breach), tort (including sole, contributory, concurrent or joint negligence) strict liability or any other form of legal theory.
