CONTRACTOR and/or DESIGNEE shall waive his rights of recourse against COMPANY and
shall indemnify and hold COMPANY’s harmless from and against any loss or liability (including
legal expenses) arising out of any claim or cause of action for loss of or damage to property of his
respective personnel and injuries to or disease or death of his respective personnel, regardless of the
cause of or reason for said damage, loss, injuries, disease or death and even if caused by negligence.
