• Venue of the Arbitration
Article 20 of the model law provides that where the parties have not designated the place of arbitration, such determination will be made by the arbitral tribunal ‘having regard to the circumstances of the case, including the convenience of the parties’. The scope of the US courts’ power to determine the site of an arbitration when the parties have not designated one is unclear under the FAA. Section 206 of the FAA, which covers arbitrations that fall under the NEW YORK convention, provides that: ‘a court having jurisdiction under this chapter may direct that arbitration be held in accordance with the agreement at any place therein provided for, whether that place is within or without the united states.’
