Charter drafters are proposing to allow more than one level of legal redress for anyone defending a case in the Supreme Court's Criminal Division for Political Office-Holders.
Chatchai Na Chiang Mai, a spokesman for the Constitution Drafting Committee (CDC), said on Wednesday the panel agreed to add an appeal avenue to the court's normal single level of redress in order to ensure more fairness for those who end up being convicted.
An appeal could be lodged within 30 days after the court hands down a guilty verdict, by directing the case to a Supreme Court judging panel for another trial. An appeal will be heard only on condition that there is new evidence which could change the case or legal issues and bring the verdict into dispute, he added.
Under current proceedings, a court ruling is considered final with no avenue for appeal. The 21-member CDC, led by Meechai Ruchupan, is expected to finish writing the new draft charter in January. If it is approved at every step of the proceedings, including a referendum, elections can be held in mid-2017, according to Prime Minister Prayut Chan-o-cha.
