Claims for unjust enrichment, besides possible claims for damages, may be asserted. Section 97(3) of the Copyright Act clarifies this point by stating that rights arising out of other provisions of German law are not affected by the preceding provisions. On the basis of a claim for unjust enrichment, a plaintiff may demand at least an equitable recovery to the extent the infringer has saved, at plaintiff's expense, an amount which he would have had to pay if he had acted lawfully. Claims for unjust enrichment may be enforced without proving intention or negligence on the part of the infringer.
