WARRANTY
1. In the event of the occurrence of any shrinkage, defect, breakdown, disrepair, deterioration or other fault or damage arising directly or indirectly due to inferior or faulty construction materials, equipment, tools or workmanship used to perform the construction of the Villa within 5 (five) years for structural defects and within 2 (two) years for non-structural defects from completion and delivery of the Villa to the Lessee. After receipt of written notice from the Lessee by the Lessor, the Lessor agrees to repair the Villa to good condition at its own expense, or if any damage is suffered to the construction works or the Villa due to carelessness, negligence, omission, error or otherwise on the part of the Lessor during the course of performing the construction works and provided that the Lessee or person being a party to the Lessee is not at fault or negligent, the Lessor shall commence to effect remedy, repair or replace within fifteen (15) days from the date of receiving notice thereof from the Lessee and shall proceed to complete the same with due diligence and expedience commensurate to the circumstances thereof. If the Lessor fails to commence such remedy, repair or replacement work within the said fifteen (15) days, the Lessee shall have the right to appoint a third party to complete such work at the Lessor’s expense without affecting warranty validity of work having been properly completed by the Lessor.
