There are six main sections in the transfer pricing documentation report – consisting of company and group overview, intercompany transactions and pricing policies, industry analysis, functional and risk analysis, choice of transfer pricing methodology and benchmarking analysis. For the first five sections, we normally send a list of questions that we may ask during the interview to you. You may look at those questions first and identify which persons of NEC TH can answer/explain. Thereafter, we will visit your company to conduct an interview. The interview may take 3 to 5 hours depending on the complexity of the business models and the readiness of information provided to us. After we gather information, we will conduct the analysis and write up a report at our office. For the last section, the benchmarking analysis is required to be performed in order to test whether the OM of NEC TH falls within the interquartile market range. Your competitors’ OMs cannot be simply used as your competitors also have related-party transactions and hence have transfer pricing issues. As a result, the Thai tax officers normally want to compare your OM with the independent and comparable companies’ OMs. In doing this, we will need to request the audited financial statements of many companies from the Ministry of Commerce and then review each audited financial statements based on quantitative and qualitative screening criteria that should be currently acceptable by the TRD. Based on this benchmarking result, we can evaluate whether NEC TH’s OM falls within the interquartile range.
