The Acceptance Test Specification will define a ”Critical Fault” as one which prevents commercial operation of the New Customised System or fails catastrophically, a ”Serious Fault” as one which has material adverse effect on the commercial operation of the New Customised System but for which there is an reasonable work-around, and a ”Minor Fault” as a fault which does not substantially affect the operation of the New Customised System. The Acceptance Test Specification will also state that the Customised System will have failed to meet the Acceptance Test Specification if there are 1 Critical Faults, or 2 Serious Faults or more than 25 Minor Faults.
(b) CUSTOMER may only refuse Acceptance of the New Customised System if it fails to meet the Acceptance Test Specification. If CUSTOMER’s Acceptance of the Customised System occurs where there are any Minor Faults, VENDOR shall remedy those faults as soon as possible and at no extra cost to CUSTOMER.
