The Magellan court's refusal to dismiss the purchaser's demand was consistent with UCC § 2-716, the provision most relevant to a suit for specific performance. According to the official commentary under UCC § 2-716, an aggrieved party's inability to cover is strong evidence of "other proper circumstances" justifying an order of specific performance. Other factors militated against dismissal of plaintiff's claim before trial: first, Magellan had already paid the price by sending its letter of credit;[80] and, second, as the goods were to be specially manufactured, replacement goods would have been difficult to secure in the open market.
