A review of work performance will be conducted quarterly.
A6. TERMINATION OF SERVICE
Except in dismissals for disciplinary reasons, written notice of termination of service would be as follows:
Sales promoter Level 01 month (or the equivalent of one (1) month's salary in lieu of notice)
On probation 02 week (or the equivalent of two (2) week's salary in lieu of notice)
An employee who terminates the contract of service is required to serve out the employee's notice of termination of service period in full, and the Company reserves the right to determine that the
notice period may or may NOT be offset by:
(a) Any unutilized leave and/or
(b) The payment of equivalent amount of salary in lieu of the notice period above.
Leave period approved before the written notice of termination should not be used directly to reduce the notice period. Additional notice has to be given so that the notice period excludes the leave period.
The Company reserves the right to terminate the contract without notice by paying the equivalent amount of salary in lieu of the notice period above.
Notwithstanding the above, the Company reserves the right to terminate this contract of service without giving the required notice or paying salary in lieu of notice in the following circumstances:
(a) Dishonesty in carrying out duties or deliberate commission of a crime against the employer and/or integrity becomes questionable;
(b) Breach of company's discipline by the employee;
Violation of the work rules and regulations or the employer's lawful and legitimate regulations or orders, where the employer had already issued a written warning, except in serious cases where the employer need not issue such a warning. A letter of warning
shall be enforceable for not more than one year, calculated from the date on which the employee committed the offence.
(c) Abandonment of a post for three consecutive working days, regardless of whether there was a holiday in between or not, for no appropriate reason.
(d) Conduct and behaviour of the employee is unbecoming and prejudicial to the professional image of the company
(e) Imprisonment under a final judgment ordering imprisonment, unless the sentence was for an offence which was committed out of negligence, or a petty offence.
When employment is defined by a period of termination, a contract of employment must expire upon the completion of the period specified in the contract without the need to give advance notice.
At the discretion of the Company, you are also liable to compensate our Company with pay according to the notice period in any of these situations. If you would like to terminate the service agreement, you shall use your best endeavour to provide advance notice of not less than 01 month, undertake to groom a Successor nominated by the Company’s Directors and ensure proper handover of business operations, duties and responsibilities.
