Philippines informed the Meeting on the national arrangements in the implementation of MLC 2006, legislative measures in compliance with Philippines’ STCW obligation, and updates on EMSA’s audit. Firstly, on the national arrangements in the implementation of MLC 2006, Philippines has its national laws and regulations on seafarers repatriation, port state control, seafarers social security, and recruitment and placement agencies. For seafarers repatriation, repatriation of workers is the primary responsibility of the principal, employer or agency that recruited or deployed the workers abroad. It is the obligation for the principal or agency to advance the repatriation costs. For port state control, the Philippine Coast Guard (PCG) is the sole Philippine Authority. The PGC follows the Inspection Procedures setforth by the Tokyo-MOU on PSC, as a Member State. For seafarers social security, it is regulated that Filipino seafarers onboard Philippines’ registered ships engaged in international voyage are entitled to compensation and benefits. Then, for recruitment and placement agencies, the existing guidelines from the Department of Labor and Employment (DOLE) and Philippines Overseas Employment Authority (POEA) shall govern the recruitment and placement and/or contracting and subcontracting work arrangement of seafarers. Secondly, on the legislative measures in the implementation of STCW Convention, it is regulated that the Department of Transportation and Communication (DOTC) through the Maritime Industry Authority (MARINA) was designated as the single and central maritime administration, exercising oversight and supervisory functions relating to STCW implementation. Thirdly, on EMSA’s audit that covers areas of quality standard system, programme and course approval, issuance of officers’ Certificate of Competence (COC), and monitoring and evaluation of training and assessment, Philippines informed actions have been taken by its Government. The Philippines Government is bent on improving its system of maritime administration, not only to satisfy EMSA, but more importantly to also ensure that Philippines maintains a stock of competent Filipino seafarers as it is the world’s premier seafarer provider with the proportion of more than 25%.
