In addition to hard law on patients’ rights to reimbursement of cross border care, a general right of access has been underlined by the Charter of the Fundamental Rights of Workers (1989), a Council Recommendation on the convergence of social protection objectives and policies (1992), the Council Conclusions on Common values and principles in European Union Health Systems (2006),and particularly by the Lisbon Treaty (in force since 2009)through a reference to the binding Charter of Fundamental Rights of the European Union, stating that “everyone has the right of access to preventive health care and the right to benefit from medical treatment under the conditions established by national laws and practices”.
