8 MONTHLY REPORTS
8.1 Monthly performance report
Within 5 days after the end of each Month, the Concessionaire is required to provide a report on its performance in implementing the Railway System. These monthly reports provide the primary mechanism for the Concessionaire to report on the status of its activities.
8.2 The Concessionaire shall submit a monthly report in accordance with the Agreement to the MRTA, which shall include, but not be limited to the following:
(a) Outstanding issues;
(b) Constraints;
(c) Contractual matters;
(d) quality performance, KPI’s
(e) patronage statistics and analysis (including ridership and trends, transportation planning surveys);
(f) Public information survey;
(g) Failure statistics and analysis;
(h) Forward planning;
(i) Accidents and major service disruptions;
(j) Engineering safety;
(k) Security issues;
(l) Public relations; Surveys
(m) Customer complaints tracking;
(n) Matters of concern;
(o) Matters arising;
(p) Any other business;
(q) Operation statistics and analysis and
(r) Detailed Operation and Maintenance cost.
8.3 Quarterly performance report
8.3.1 Within 21 days after the end of each Quarterly, the Concessionaire is required to provide a report on its performance in implementing the Railway System. These quarterly reports provide the primary mechanism for the Concessionaire to report on the statistical performance in three months period and analysis.
8.3.2 MRTA shall conduct a special assessment after the Concessionaire’s operation and maintenance performance does not meet the MRTA’s requirements for two consecutive quarters. If the result of assessment show signs of a decrease in performance, the MRTA shall instruct the Concessionaire to submit and implement remedial plans to improve performance in accordance with Sub-clause 16.4.
8.4 Annual Report
Within 30 days after the end of each business year, the Concessionaire is required to provide a report on its performance in implementing the Railway System. These annual report shall include the statistical performance and activities in twelve months period and the life cycle cost analysis of an asset which is defined as the total cost, in present value or annual value, that includes the initial costs, maintenance, repair and renewal costs over the service life.
8.5 Audit
If any information dispute is notified under the Agreement it shall be resolved as follows:
(a) Within 7 days of submission of the relevant report, the MRTA shall notify the area of noncompliance and provide direction or request on resolving all error in the report. The Concessionaire shall complete the report and resubmit to the MRTA for review and evaluation;
(b) Within 10 days from receiving the complete report referred to in sub-clause (a), the MRTA shall notify result of review and evaluation of the detail of compliance report;
(c) Within 28 days from receiving the notification of evaluation, the parties shall meet to discuss the disputed aspects with a view to resolving all disputes in good faith. After meeting with a view to resolving all disputes, parties shall provide a written summary of the agreed result and the Concessionaire shall submit new report to replace incorrect relevant report referred to in sub-clause (b).
