Nottebohm was prevented from exhausting all the remedies and that it would have been ineffective anyway.
In regard of his properties that was given no reply by the Minister for the application for exoneration made by Nottebohm and he had exhausted all the local remedies provided under municipal and international
And for the properties where the Minister had made a decision, Nottebohm was not required to exhaust the local remedies available under international law.
In the event that the court could not hold and declare the aforementioned claims, the Court should declare and hold that the claim is admissible since there was a breach of international law by Guatemala to the treatment of the person and property of Nottebohm.
